KidSteps Terms of Service

1. Who we are

KidSteps is a service provided by Innovation Haus B.V., based in the Netherlands, reachable at support@kidsteps.app.

2. Acceptance

By downloading, installing, or using KidSteps, you agree to these Terms of Service. If you do not agree, do not use the app.

3. The service

KidSteps is an app that lets parents capture their child's milestones in a digital memory book. We offer:

• Free basic functionality — limited moments and one child per account
• Premium subscription — unlimited moments, multiple children, extra features (see app)

4. Your account

• You are responsible for the confidentiality of your login credentials
• Accounts are personal and non-transferable
• You must be at least 16 years old to create an account, or have parental/guardian consent
• We may suspend accounts for misuse or violation of these terms

5. Your content

All photos, text, and other material you add ("Content") remain your property. You declare:

• To have the rights to the Content (your own photos or photos you have permission to use)
• Not to add content that is illegal, offensive, hateful, or infringing
• To respect the privacy of other persons

By adding Content, you grant us a limited right to store and display it to you (and any family viewers you designate). This right ends as soon as you delete the Content or close your account.

We do not routinely review your Content but may remove it if it violates laws or after a legitimate complaint.

6. Subscriptions and payment

• Premium is offered as an auto-renewing subscription (monthly or yearly)
• Payments are processed through the App Store or Google Play. Their terms also apply there
• Subscriptions renew automatically unless you cancel at least 24 hours before the renewal date via your App Store / Play Store account
• Prices may be adjusted; changes are announced at least 30 days in advance
• Right of withdrawal: for digital services, there is no right of withdrawal once you explicitly agree to immediate delivery (you get premium features immediately after purchase)

7. Intellectual property

The KidSteps app, logo, design, and source code are the property of Innovation Haus B.V. You may not copy, distribute, reverse-engineer, or create derivative works.

8. Availability

We strive for maximum availability but cannot guarantee 100% uptime. Maintenance, outages, or external causes may lead to temporary unavailability. We are not liable for the consequences.

9. Liability

To the extent permitted by law:

• KidSteps is provided "as-is", without warranties of any kind
• We are not liable for indirect damages, lost profits, or data loss
• Our total liability is limited to the amount you paid for the service in the last 12 months

These limitations do not apply in cases of intent or gross negligence on our part.

10. Termination

• You can delete your account at any time via Settings → Account → Delete account
• We may terminate your account for misuse or unpaid invoices, after reasonable warning
• After deletion, invoice data is retained per legal obligation (7 years)

11. Changes

We may update these terms. Material changes are communicated at least 30 days in advance by email or in the app. Continued use after that constitutes acceptance.

12. Governing law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
